{"id":5266,"date":"2021-02-16T15:15:29","date_gmt":"2021-02-16T14:15:29","guid":{"rendered":"https:\/\/www.d-kart.de\/?page_id=5266"},"modified":"2021-02-16T15:15:30","modified_gmt":"2021-02-16T14:15:30","slug":"9-wendy-ng-from-australia","status":"publish","type":"page","link":"https:\/\/www.d-kart.de\/en\/9-wendy-ng-from-australia\/","title":{"rendered":"9: Wendy Ng from Australia"},"content":{"rendered":"\n<p><strong><em>A key competition law development in Australia in 2020: <\/em><\/strong>The Australian Competition and Consumer Commission (ACCC), at the Australian Federal Government\u2019s <a href=\"https:\/\/ministers.treasury.gov.au\/ministers\/josh-frydenberg-2018\/media-releases\/accc-mandatory-code-conduct-govern-commercial\">direction<\/a>, has been developing a mandatory code of conduct to address bargaining power imbalances between Australian news media businesses and digital platforms, and in particular, Google and Facebook. Undoubtedly, the ACCC has significant expertise in this area, having conducted its <a href=\"https:\/\/www.accc.gov.au\/focus-areas\/inquiries-ongoing\/digital-platforms-inquiry\/final-report-executive-summary\">2019 Digital Platforms Inquiry<\/a> and examined this exact issue. But let\u2019s be frank \u2013 the Federal Government is also leveraging the ACCC\u2019s reputation, credibility, and independence to deal with what is a <a href=\"https:\/\/www.smh.com.au\/national\/why-are-tech-giants-opposing-a-news-media-bargaining-code-20200910-p55u5y.html\">highly political issue<\/a>. Since the release of the <a href=\"https:\/\/www.accc.gov.au\/focus-areas\/digital-platforms\/draft-news-media-bargaining-code\">draft code<\/a> in July 2020, Google and Facebook have come out swinging <a href=\"https:\/\/www.smh.com.au\/business\/companies\/payments-negotiations-with-media-companies-unworkable-warns-google-boss-20200929-p560e8.html\">against the code<\/a>, in particular the requirement to pay news businesses for content. For example, Facebook has threatened to stop displaying any news on its Australian platforms and Google has claimed that it will be forced to stop updating its local search engine and hand over users\u2019 personal data to news businesses, and that Australians\u2019 free access to its services is at risk. The ACCC has been no slouch either, responding that these claims are <a href=\"https:\/\/www.accc.gov.au\/media-release\/statement-on-facebook\">ill-timed and misconceived<\/a>, and <a href=\"https:\/\/www.accc.gov.au\/media-release\/response-to-google-open-letter\">contain misinformation<\/a>. The code is expected to be legislated into law at the end of this year, so watch this space \u2013 not only to see what will actually end up in the code and if Facebook\u2019s and Google\u2019s threats transpire, but also if this code might prompt other countries to adopt similar forms of regulation.<\/p>\n\n\n\n<p><strong><em>A place to visit in Australia after the pandemic: <\/em><\/strong>The beating heart of Australia \u2013 Uluru.
