Hola\neveryone! Last year I heard Fr\u00e9d\u00e9ric Jenny say, at the Latin American and Caribbean Competition Forum<\/a>, that we lived in interesting times\ndue to the emergence of new antitrust challenges associated with the rise of\nplatform economies. Little did we knew that we would experience even more\ninteresting times due to the emergence of a virus! <\/p>\n\n\n\n

It\u2019s difficult to track how competition authorities around the globe have reacted to the COVID-19\u2019s challenge. There\u2019s a new announcement almost every day! Probably you have heard from the European Commission<\/a>, the European Competition Network<\/a>, as well as the FTC and DOJ<\/a>. But what about the 31 competition authorities<\/a> of Latin America and the Caribbean? My colleagues of the Competition Centre<\/a> (based at the Universidad Adolfo Iba\u00f1ez) published a brief analysis of the reactions of competition authorities, including several Latin American agencies. At least in eight countries of the region, the agencies partially or totally suspended their investigations (Argentina, Chile, Colombia, Dominican Republic<\/a>, El Salvador<\/a>, Honduras<\/a>, Mexico, Per\u00fa). <\/p>\n\n\n\n

Furthermore,\nBrazil\u2019s CADE<\/a> opened a formal investigation due to alleged\nexcessive pricing of face masks, hand sanitizers and alcohol. Meanwhile, the\ngovernment of Colombia announced<\/a> that the competition authority will\nmonitor a list of goods (e.g. basic needs and health related) to prevent\nexcessive pricing. Other governments have implemented more stringent\ninterventions, including price controls that are monitored by the competition\nauthority, such as the case of El Salvador<\/a>.<\/p>\n\n\n\n

Finally,\nsome authorities have informed the temporary easing of competition law\nenforcement. Mexico\u2019s COFECE<\/a>, for example, stated that the agency will not\npursue horizontal agreements whose purpose is to increase supply, avoid\nshortages, and ensure the supply of goods and services associated with the\ncoronavirus contingency. Furthermore, the Mexican agency pledged to undertake\nan expedited review of the mergers that are associated with COVID-19.<\/p>\n\n\n\n

We are\ncertainly living interesting times, perhaps not happy times\u2026 Nonetheless, let\u2019s\nstay tuned with our passions and study \u201cpandemic antitrust\u201d from home office. <\/p>\n\n\n\n
